ITC Opens DRAM Patent Complaint Against Micron, Lenovo; Fed Reviews Colorado Bank Holding Application
The U.S. International Trade Commission is soliciting public-interest comments on a Section 337 DRAM complaint filed by Netlist, Inc., while the Federal Reserve considers a bank holding company application in Colorado.
ITC: Netlist Files Section 337 DRAM Complaint
The U.S. International Trade Commission has received a complaint filed on behalf of Netlist, Inc. on August 11, 2026, alleging violations of section 337 of the Tariff Act of 1930 (19 U.S.C. 1337) in connection with certain dynamic random access memory (DRAM) devices, products containing the same, and components thereof. The matter is docketed as DN 3930.
The complaint names six respondents: Micron Technology, Inc. of Boise, ID; Micron Semiconductor Products, Inc. of Allen, TX; Hewlett Packard Enterprise Co. of Spring, TX; Lenovo Group Ltd. of China; Lenovo (United States) Inc. of Morrisville, NC; and Super Micro Computer, Inc. of San Jose, CA. The allegations concern the importation into the United States, the sale for importation, and the sale within the United States after importation of the named DRAM products.
Netlist requests that the Commission issue a limited exclusion order, cease and desist orders, and impose a bond upon respondents' alleged infringing articles during the 60-day Presidential review period pursuant to 19 U.S.C. 1337(j).
The Commission is soliciting public-interest comments pursuant to Section 210.8(b) of its Rules of Practice and Procedure. The Commission states it is particularly interested in comments that explain how the articles potentially subject to the requested remedial orders are used in the United States; identify any public health, safety, or welfare concerns relating to the requested remedial orders; identify like or directly competitive articles that complainant, its licensees, or third parties make in the United States which could replace the subject articles if they were to be excluded; indicate whether complainant, complainant's licensees, and/or third party suppliers have the capacity to replace the volume of articles potentially subject to the requested exclusion order and/or a cease and desist order within a commercially reasonable time; and explain how the requested remedial orders would impact United States consumers.
Written submissions on the public interest, as well as submissions on other issues, must be filed no later than the close of business eight calendar days after the date of publication of the notice in the Federal Register. Complainant may file replies no later than three calendar days after the date on which any initial submissions were due. All submissions and replies are limited to five pages in length, inclusive of attachments, and must be filed electronically through the Commission's Electronic Document Information System (EDIS). The Commission notes there will be further opportunities for comment on the public interest after the issuance of any final initial determination in the investigation.
Federal Reserve: Colorado Bank Holding Company Application
Separately, the Federal Reserve System has published notice that Silver Queen Financial Services, Inc. of Greenwood Village, Colorado has applied to the Board for approval to become a bank holding company by acquiring Colorado Federal Savings Bank, also of Greenwood Village, Colorado. The application was filed pursuant to the Bank Holding Company Act of 1956 (12 U.S.C. 1841 et seq.), Regulation Y (12 CFR part 225), and all other applicable statutes and regulations.
The application is being processed through the Federal Reserve Bank of Kansas City. Public portions of the application are available for inspection at that bank and at the offices of the Board of Governors, and may also be obtained through the Board's Freedom of Information Office. Interested persons may express views in writing on the standards enumerated in the BHC Act (12 U.S.C. 1842(c)); the Board notes that comments received are subject to public disclosure and will generally be made available without change.
