EEOC to Vote on Arrest-Record Guidance Rescission; OSM Finalizes Wyoming Mining Rule Fix

Three federal actions published October 26, 2026 cover an EEOC commission vote on Title VII enforcement guidance, a surface mining regulatory correction in Wyoming, and a clarifying fee schedule amendment at MIAX Pearl.

EEOC: Open Commission Meeting on Title VII Arrest-Record Guidance

The Equal Employment Opportunity Commission has noticed an open public meeting for Friday, October 30, 2026, at 1:00 p.m. Eastern Time, to be held at the Jacqueline A. Berrien Training Center, 131 M Street NE, Washington, DC 20507. The sole item on the agenda is the Rescission of Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act. The notice states that the public will be able to observe the Commission's deliberations and voting, though public observation does not include participation.

The meeting will also be accessible as a listen-only audio option; connection instructions are to be posted on www.eeoc.gov at least 24 hours before the meeting. ASL services will be available for in-person attendees, and a closed captioning link will be posted on the Commission's website prior to the meeting. Members of the public wishing to attend in person must register by email, providing their name as it appears on a driver's license or other government-issued identification, at least 24 hours before the meeting. Those wishing to take still photographs, video, or audio recordings must seek permission from the Executive Secretariat at least 24 hours in advance to discuss the manner of recording and ensure it does not interfere with the meeting. OSM Approves Wyoming Typographical Corrections to Coal Exploration Rules

The Office of Surface Mining Reclamation and Enforcement (OSM) is approving an amendment to the Wyoming regulatory program under the Surface Mining Control and Reclamation Act of 1977, with an effective date of November 25, 2026. The amendment, submitted by the Wyoming Land Quality Division (WLQD) under SATS No. WY-055-FOR (Docket ID No. OSM-2025-0002), addresses typographical errors that OSM identified but did not approve in its January 19, 2024 partial approval of a prior amendment (SATS No. WY-050-FOR; Docket ID No. OSM-2021-0004), which itself took effect February 20, 2024.

As the document explains, the 2024 final rule identified several specific errors in WLQD's proposed language for Chapter 14 of the Land Quality Division Coal Rules and Regulations governing coal exploration by drilling. At subsection 3(a), the word "location" had been used instead of the previously approved word "condition," rendering the rule, in OSM's description, illogical. In subsections 3(c), 3(d), 3(e), and 4(d), WLQD omitted the word "Division" from references to its own "Land Quality Division Coal Rules and Regulations," leaving the title incomplete. OSM had communicated these errors to WLQD by letter dated October 24, 2023, and offered to delay rulemaking under WY-050-FOR to accommodate corrections; WLQD responded by letter dated November 22, 2023, that its internal rulemaking processes would preclude corrections within the allowable timeframe.

The document further explains that OSM had also flagged additional minor errors by email on July 27, 2021, during its initial review of the original amendment: in subsection 2(e)(iii), the word "part" was misspelled "peart"; at subsection 2(g), a semicolon appeared where a colon was likely intended after the first use of "shall"; and at subsection 2(h), a comma appeared where a period was likely intended after the second use of "material." WLQD subsequently undertook rulemaking to correct all of these errors; the revised rules were approved by the Environmental Quality Council on October 23, 2024, filed with the Wyoming Secretary of State on January 3, 2025, and transmitted to OSM on January 22, 2025. The affected regulation is 30 CFR Part 950.

For background, the document notes that Section 503(a) of SMCRA permits a state to assume primacy for regulation of surface coal mining and reclamation operations on non-Federal and non-Indian lands within its borders, and that the Secretary of the Interior conditionally approved the Wyoming program on November 26, 1980.

SEC: MIAX Pearl Equities Fee Schedule Clarification

The Securities and Exchange Commission published notice that MIAX PEARL, LLC filed a proposed rule change on October 14, 2026, that took immediate effectiveness. The change amends Section 1(e) of the MIAX Pearl Equities Fee Schedule to add liquidity indicator codes "Ep" and "Fp" below the table titled "Midpoint Peg Order Adding Liquidity at Midpoint Volume Tiers." The Exchange describes the change as non-substantive and clarifying, stating that those liquidity indicator codes have been applicable to such executions since they were first established.

As the document explains, the Exchange provides a standard rebate of ($0.00200) per share for executions of Midpoint Peg Orders in securities priced at or above $1.00 per share that execute at the midpoint of the Protected NBBO and add liquidity to the Exchange in all Tapes. The Exchange also operates a tiered pricing structure — the Midpoint Volume Tiers Program — under which Equity Members may qualify for enhanced rebates based on achieving certain average daily added volume thresholds. Under Tier 1, members achieving a Midpoint ADAV equal to or greater than 500,000 shares may qualify for an enhanced rebate of ($0.0025) per share. Under Tier 2, members achieving a Midpoint ADAV equal to or greater than 1,000,000 shares may qualify for an enhanced rebate of ($0.0027) per share. The Commission published the notice to solicit comments from interested persons.
