Antidumping Investigation: Amended Preliminary Determination for Truck Bed Covers from China
The Commerce Department's International Trade Administration (ITA) has amended its preliminary affirmative determination in the less-than-fair-value (LTFV) investigation of truck bed covers from the People's Republic of China, acting to correct what it identified as a significant ministerial error. The amendment is applicable as of November 2, 2026. The period of investigation covers July 1, 2025, through December 31, 2025.
The original Preliminary Determination was published in the Federal Register on October 1, 2026 (91 FR 62485). On October 6, 2026, Ningbo Scarman International Trading Co., Ltd (Ningbo Scarman), a non-selected respondent that had qualified for a separate rate, timely alleged that Commerce made significant ministerial errors in assigning its estimated weighted-average dumping margins.
Commerce defines a ministerial error as including "errors in addition, subtraction, or other arithmetic function, clerical error resulting from inaccurate copying, duplication, or the like, and any other similar type of unintentional error." Under 19 CFR 351.224(g), an error is considered "significant" if its correction would result in a change of at least five absolute percentage points in, but not less than 25 percent of, the weighted-average dumping margin calculated in the preliminary determination — or if it causes a margin to cross the de minimis threshold in either direction.
Commerce found that it had made a significant ministerial error by incorrectly listing the producer when assigning a non-selected preliminary weighted-average dumping margin to Ningbo Scarman and its producer, Ningbo Scarman Auto Parts Co., Ltd (Ningbo Auto Parts). Pursuant to 19 CFR 351.224(e), Commerce amended its Preliminary Determination to correct the error by properly designating the producer/exporter chain as Ningbo Scarman/Ningbo Auto Parts and assigning that chain the non-selected separate rate calculated in the original Preliminary Determination. The notice states that no other changes were made to any other producer/exporter combination as published in the Preliminary Determination. A detailed discussion of the alleged errors and Commerce's analysis is contained in the concurrently issued Ministerial Error Memorandum.
