HUD Opens Comment Period on FHA Loss Mitigation Data Collection; FAA Establishes Ottawa, IL Heliport Airspace

HUD: FHA Loss Mitigation Information Collection Revision

The Department of Housing and Urban Development has published a 60-day notice soliciting public comment on a proposed revision to an existing information collection tied to FHA's Loss Mitigation programs, with comments due by November 23, 2026. The collection, titled "FHA-Insured Mortgage Loan Servicing Involving the Loss Mitigation Programs," carries OMB Approval Number 2502-0589 and is classified as a revision of a currently approved collection.

According to the notice, FHA's Loss Mitigation program options — governed under 24 CFR 203.501 — provide mortgagees with tools to bring delinquent FHA-insured mortgages current as quickly as possible, offer an alternative to foreclosure where feasible, and minimize losses to FHA's Mutual Mortgage Insurance Fund. The notice explains that FHA Early Default Intervention Tools, in addition to FHA Loss Mitigation Home Retention Options, promote reinstatement of the mortgage and allow borrowers to retain home ownership, while disposition options provide a foreclosure alternative for borrowers who cannot recover from a default.

The revision involves four HUD forms: HUD-90035, HUD-90045, HUD-90051, and HUD-90052. The notice states that for forms HUD-90035 and HUD-90045, the public reporting burden language was revised and the forms were updated to reflect Pre-Foreclosure Sales Program changes that have occurred in recent years. For forms HUD-90051 and HUD-90052, the public reporting burden language was similarly revised. The notice further states that one supplemental document — the Reinstatement Advance Payment (RAP) Repayment Agreement — has been added to the collection, and that the existing partial claim supplemental document, the Partial Claim Promissory Note and Partial Claim Subordinate Mortgage, has been updated.

HUD estimates the collection will cover 990,284 respondents — mortgagees or borrowers — generating 3,431,820 responses on a monthly frequency. The agency estimates an average burden of 0.69 hours per response, for a total estimated burden of 1,458,337 hours, at an hourly cost of $25.25 and an estimated annual cost of $36,823,021. HUD is soliciting comment on the necessity and practical utility of the collection, the accuracy of the burden estimate, ways to enhance the quality and clarity of the information collected, and ways to minimize respondent burden, including through automated collection techniques or electronic submission.

FAA: Class E Airspace Established at Ottawa, Illinois Heliport

The Federal Aviation Administration has issued a final rule establishing Class E airspace at OSF St Francis Medical Center Heliport in Ottawa, Illinois, effective at 0901 UTC on December 24, 2026. The rule amends 14 CFR part 71 by establishing Class E airspace extending upward from 700 feet above the surface within a 6.8-mile radius of the heliport.

The FAA states that this action supports new instrument procedures being developed for the heliport and is intended to support instrument flight rule (IFR) operations. The rulemaking originated with an NPRM published in the Federal Register on July 24, 2026 (91 FR 46759) under Docket No. FAA-2026-8548. The FAA received one comment in response to that proposal, which expressed support for the NPRM.

The rule amends FAA Order JO 7400.11M, Airspace Designations and Reporting Points, dated July 30, 2026, and effective September 15, 2026. Class E airspace designations are published in paragraph 6005 of that order, which is incorporated by reference in 14 CFR 71.1 on an annual basis. The FAA determined that the rule is not a significant regulatory action under Executive Order 12866, is not a significant rule under DOT Order 2100.6B, and is expected to result in at most de minimis costs from compliance or minor flight rerouting for operators choosing to navigate around the controlled airspace. The agency also determined that the action qualifies for categorical exclusion under the National Environmental Policy Act.
