NRC Issues Correction to FY 2026 Fee Schedule for Human-Use Nuclear Material Licenses

The Nuclear Regulatory Commission has published a correction to its Fiscal Year 2026 fee schedule rule, revising annual fee figures in 10 CFR 171.16 for licenses covering the human use of byproduct, source, and special nuclear materials.

The Nuclear Regulatory Commission (NRC) published a correction on October 19, 2026, to its Fiscal Year 2026 fee recovery rule, which originally appeared in the Federal Register on June 16, 2026. The correction amends the fee schedule set out in 10 CFR Parts 15, 170, and 171, specifically targeting Table 2 in Section 171.16, paragraph (d), item 7.C, which governs annual fees for a category of human-use nuclear material licenses.

What the Correction Addresses

The affected license category — designated 7.C in Table 2 to § 171.16(d) — covers other licenses issued under parts 30, 35, 40, and 70 of Title 10 for the human use of byproduct material, source material, and/or special nuclear material. Excluded from this category are licenses for byproduct material, source material, or special nuclear material in sealed sources contained in teletherapy devices. The category also includes the possession and use of source material for shielding when authorized on the same license.

The correction establishes three fee tiers based on the number of locations of use under a single license. For licenses with 1 to 5 locations of use — associated with Program Codes 02120, 02121, 02200, 02201, 02210, 02220, 02230, 02231, 02240, and 221601 — the corrected annual fee is $23,300. For licenses covering 6 to 20 locations of use — associated with Program Codes 04810, 04812, 04814, 04816, 04818, 04820, 04822, 04824, 04826, and 04828 — the corrected annual fee is $33,000. The correction also restates the fee tier for licenses with more than 20 locations of use, associated with Program Codes 04811, 04813, 04815, 04817, 04819, 04821, 04823, 04825, 04827, and 04829.

The correction document references the original rule document number 2026-12067 and specifies that the erroneous text appeared on pages 6504 and 6505 of the original June 16, 2026 publication. The correcting notice was filed October 16, 2026, and published October 19, 2026, in Volume 91, Number 200 of the Federal Register.
